COMPETITION PARTICIPATION TERMS & CONSENT FORM

— Consent Regarding Liability, Use of Likeness, Photography, Recording, and Distribution —

By participating in INTERNATIONAL POLEARTIST. EXPO 2027 (the “Competition”), organized by International Poleartist. Association (the “Organizer”), I confirm that I have read and understood these Terms and agree to the following provisions.

Article 1 – Agreement to Competition Rules

Participants must review and comply with the Competition entry guidelines, competition rules, prohibited actions, safety regulations, judging criteria, venue rules, and any other rules established by the Organizer. If a participant violates any of these rules, the Organizer may, depending on the nature and severity of the violation, impose point deductions, disqualification, suspension from participation, removal from the venue, or any other measures necessary for the safe and proper operation of the Competition.

Article 2 – Health Condition and Risks Associated with Participation

Participants acknowledge and fully understand that pole dance and performances conducted at the Competition involve inherent risks of injury resulting from falls, slips, collisions, and other accidents. Each participant is responsible for assessing their own health condition, physical ability, and technical skill level and must participate only when they are in a condition that allows them to perform safely. If a participant is unwell, injured, or otherwise unable to perform safely, they must promptly notify the Organizer. The Organizer may require a participant to stop a performance or withdraw from participation if the Organizer determines that doing so is necessary for safety reasons.

Article 3 – Accidents, Injuries, and Emergency Assistance

If an accident, injury, sudden illness, or other emergency occurs during participation in the Competition, the Organizer may, depending on the circumstances, provide first aid, request emergency medical assistance, contact a medical institution, or take any other measures reasonably deemed necessary. To the extent permitted by applicable law, the Organizer shall not be liable for damages arising from a participant’s own actions, risks ordinarily associated with the Competition, the participant’s health condition, violation of the rules, or other circumstances not attributable to the Organizer. This limitation shall not apply to damages caused by the Organizer’s intentional misconduct or gross negligence.

Article 4 – Personal Belongings, Loss, Theft, and Damage

Participants are responsible for managing and safeguarding all personal belongings brought into the venue, including costumes, shoes, accessories, cameras and recording equipment, mobile phones, valuables, and other personal property. Except where attributable to the Organizer, the Organizer shall not be liable for any loss, theft, mix-up, or damage involving participants’ personal belongings.

Article 5 – Damage to the Venue, Equipment, or Property

If a participant intentionally or negligently causes damage to the venue, poles, stage, lighting or sound equipment, dressing rooms, fixtures, or any other property belonging to the Organizer or a third party, the participant shall be responsible for such damage in accordance with applicable law. If requested by the Organizer or venue management to provide information regarding such damage, the participant must reasonably cooperate with the investigation and confirmation of the circumstances.

Article 6 – Photography, Video, Audio, Likeness, and Use of Recordings

Participants consent to being photographed, filmed, and otherwise recorded during the Competition by the Organizer or photographers, videographers, or other persons designated or authorized by the Organizer. Such recordings may include the participant’s performance, appearance, likeness, name, stage name, voice, interviews, and other aspects of their participation in the Competition. Participants grant the Organizer permission to use such photographs, videos, audio recordings, and other recorded materials for purposes related to the Competition and the Organizer’s activities, including:

• Competition records and publication of results
• The Organizer’s official website
• Social media and video-sharing platforms
• Live streaming and archived streaming
• Advertising, publicity, and promotional activities
• Posters, brochures, and other printed materials
• Provision to news and media organizations
• Promotion and publicity for future competitions and events
• Other reasonable uses for introducing or promoting the Competition or the Organizer’s activities

To the extent permitted by applicable law, the Organizer may use, publish, edit, reproduce, publicly transmit, stream, distribute, or otherwise use such materials in any territory, for any period of time, and through any medium. Unless otherwise agreed in writing, participants shall not be entitled to additional performance fees, likeness fees, usage fees, or other compensation in connection with the uses described above. The Organizer shall not use such materials in a manner that unjustifiably harms a participant’s honor, reputation, or personal dignity.

Article 7 – Rights Relating to Performances, Choreography, and Materials

Participants are responsible for obtaining any permissions or rights necessary to ensure that videos, choreography, images, and other materials they use do not infringe any third party’s copyright, portrait rights, or other rights. If any dispute, claim, or other issue with a third party arises from a participant’s infringement of such rights, the participant shall handle the matter at their own responsibility and expense, except to the extent that the matter is attributable to the Organizer. Where any procedures relating to the performance, recording, streaming, or other use of music at the Competition are legally required or required under applicable rights-management arrangements to be handled by the Organizer, the Organizer shall take appropriate action. However, where a participant uses independently edited or modified audio recordings or other materials for which rights clearance is required on the participant’s side, the participant must provide the Organizer with the necessary information and cooperate with any required rights-clearance procedures.

Article 8 – Live Streaming, Recording, and Archived Distribution

Participants understand and agree that all or part of the Competition may be streamed, recorded, made available on demand, published on social media or video-sharing platforms, or otherwise distributed or made publicly available in Japan and internationally, and that their performance, likeness, name, stage name, voice, and other identifying elements may be included. Participants acknowledge that once photographs, videos, or other materials have been lawfully made available online, it may be impossible for the Organizer to completely prevent third parties from saving, sharing, reposting, or otherwise using such materials. If the Organizer becomes aware of unauthorized reposting or similar unauthorized use, the Organizer may take reasonable action as appropriate.

Article 9 – Changes, Postponement, or Cancellation of the Competition

The Organizer may change the format, date, time, schedule, venue, or other aspects of the Competition, or postpone or cancel all or part of the Competition, due to natural disasters, earthquakes, typhoons, infectious diseases, transportation disruptions, venue equipment failures, requests or orders from governmental authorities, or other circumstances beyond the Organizer’s reasonable control. In such cases, the handling of entry fees, ticket fees, and other payments shall be governed by the Competition entry guidelines, terms of sale, and any other rules separately established by the Organizer.

Article 10 – Participation of Minors and Parental/Legal Guardian Consent

If a participant is under 18 years of age, their parent or legal guardian must review and understand these Terms, the Competition entry guidelines, competition rules, and other applicable rules and consent to the participant’s participation in the Competition. The parent or legal guardian must also consent to the photography, filming, audio recording, recording and use of the participant’s likeness and name, live streaming, archived streaming, social media publication, advertising, publicity, and other uses described in these Terms.

Article 11 – Handling of Personal Information

The Organizer will process participants’ names, dates of birth, contact information, affiliations, emergency contact information, and other personal information obtained through entry and Competition operations only to the extent necessary for the following purposes:

• Entry processing and identity verification
• Competition operations and communications with participants
• Verification of eligibility
• Competition programs and publication of results
• Emergency communications and safety management
• Other purposes necessary for the proper operation of the Competition

Except where required or permitted by law or where another legitimate basis exists, personal information will not be used beyond the scope of the stated purposes.

Article 12 – Rule Violations and False Information

If a participant provides false information when entering or participating in the Competition, is subsequently found not to meet the eligibility requirements, or commits a serious violation of these Terms or other Competition rules, the Organizer may revoke the participant’s eligibility or disqualify the participant. The handling of entry fees and other payments in such cases shall be governed by the Competition entry guidelines and other rules established by the Organizer.

Article 13 – Governing Law and Dispute Resolution

These Terms, participation in the Competition, and all related matters shall be governed by the laws of Japan. If any dispute arises between a participant and the Organizer in connection with the Competition or these Terms, both parties shall first attempt in good faith to resolve the dispute through consultation. If the dispute cannot be resolved through consultation, any litigation arising out of or relating to the Competition or these Terms shall, to the extent permitted by applicable law, be subject in the first instance to the jurisdiction of the competent court in Japan having jurisdiction over the Organizer’s principal place of business.

Article 14 – Japanese and Foreign-Language Versions

These Terms may be translated into English or other languages. Any foreign-language version is provided to assist international participants in understanding these Terms. If there is any discrepancy or difference in interpretation between the Japanese version and a foreign-language version, the Japanese version shall, to the extent permitted by applicable law, prevail and serve as the basis for interpretation.

 

PARTICIPANT CONFIRMATION AND CONSENT

I confirm that I have read and understood these Terms, the Competition entry guidelines, competition rules, prohibited actions, and applicable rules, and I agree to comply with them and participate in the Competition accordingly. By completing entry, I am deemed to have agreed to these Terms.

FOR PARTICIPANTS UNDER 18 YEARS OF AGE

As the parent or legal guardian of the participant named above, I confirm that I have reviewed and understood these Terms, the Competition entry guidelines, competition rules, and other applicable rules, and I consent to the participant’s participation in the Competition. I also consent to the photography, filming, audio recording, recording, distribution, publication, advertising, publicity, and other uses of the participant’s photographs, videos, voice, likeness, name, and other materials as provided in these Terms.
